Attorney Edna Atkins said a certified copy of the indictment from South Bend, was not sufficient proof that her client, Robbi Lee Stansberry, is the same Robbi Stansberry accused in the indictment.

U.S. Magistrate Richard Kopf granted Ms. Atkins' request and scheduled a hearing for next Friday. A handed federal grand jury indictment up April 15 in South Bend but kept sealed until last Tuesday accuses Robbi Stansberry of one count of conspiracy to distribute marijuana, two counts of distribution of marijuana and one count of causing interstate travel to further marijuana trafficking. Stansberry was one of 63 people accused in two indictments of harvesting marijuana in Indiana, Iowa and Ne braska, storing it in northwest Indiana, then taking it to Florida, where it was colored with red dye and used as a filler for more expensive marijuana brought in from other countries.

Stansberry, 26, is an employee of a packing plant at Schuyler, Neb. After he appeared two hours late for the hearing Friday, Kopf ordered him to contact a federal probation officer every two days while he is awaiting next week's hearing. Stansberry told the magistrate he was delayed because he received a traffic ticket while traveling to Omaha.
